Applicant Acceptable Use Policy
Acceptable Use Policy: Applicants
Welcome to CreditXpert, a cloud-based SaaS platform that provides optimization products (“Solutions”) that empower the mortgage community.
When you access or use this website or the Solutions, you agree to this Acceptable Use Policy and the CreditXpert Privacy Policy.
Because you authorized your Mortgage Originator/Lender to share Credit Data with CreditXpert, CreditXpert’s Solutions will be used by your Mortgage Originator for the purpose of providing a Credit Optimization Plan. “Credit Optimization Plan” or “Plan” means a credit-related analytical report, query or simulation about an applicant based on one or more applicable Bureau Files and other data. It does not mean and does not include an analysis, approval or denial of any mortgage loan application.
Registration Requirements. To access the Solutions, you must first register for a CreditXpert user account. By registering, you certify that: (a) you are 18 years of age or older; (b) you are a U.S. resident and have a valid U.S. Social Security number; (c) any information you provide to CreditXpert, both when you register and in the future, is and will be true, accurate, current and complete; (d) you are only registering an account for yourself; and (e) you will keep all information up-to-date. CreditXpert, at its sole discretion, has the right to immediately suspend or terminate your user account, if at any time you violate, or CreditXpert has reasonable grounds to suspect that you have violated, any of the registration requirements or obligations as specified in this section. The Solution is currently not able to accept and process joint registrations for two or more adults under the same account. Neither your spouse nor any other adult will be enrolled in the Solutions under your account.
Account Security. In order to maintain the security of your account, you agree: (a) to create a password that is unique to CreditXpert and is not, and will not be, re-used across other, unaffiliated services; (b) not to sell, transfer, or assign your account to anyone else; (c) to keep your password confidential; (d) not to share your password; and (e) not to allow anyone else to log into the Solutions as you. You are responsible for all activities that occur under your user account. If you believe that your account is no longer secure, notify CreditXpert immediately by clicking here.
Your Consent. When you register as a user, you authorize CreditXpert to create and maintain an account in your name using your account registration information and other information that may be collected about you in accordance with the Privacy Policy as part of providing the Solutions. When registering, you: (a) authorize your wireless carrier to share your account device information with CreditXpert’s third-party service provider, only to verify your identity and prevent fraud.
Restrictions. All aspects of the Solutions (including content, messages, data, information, text, sound, photos, graphics, video, icons, code and other material), and the infrastructure used to provide the Solutions, are proprietary to CreditXpert or its licensors. You will not modify, translate, adapt, edit, copy, distribute, transmit, display, perform, decompile, reverse engineer, reproduce, publish, license, create derivative works from, transfer, or share, lease, sell or otherwise distribute, interfere with or disrupt the integrity of any aspect of the Solution. You may not access the Solutions to build a competitive product or service, or attempt to reconstruct or discover any source code, underlying ideas, algorithms, file formats or programming or interoperability interfaces of the Solution by any means. You may not use or access the Solutions outside of the USA.
Enforcement of AUP. CreditXpert reserves the right to suspend your account use or take other appropriate remedial action to address actual or suspected violations of the AUP. CreditXpert will use reasonable efforts to notify you and provide an opportunity to cure before taking such action, if practicable and if permitted by law. You will cooperate with CreditXpert in investigating complaints about potential violations and in taking any corrective action that CreditXpert deems necessary to address such violations. If you become aware of any activity that violates this AUP, you shall promptly notify CreditXpert of any such violation and you shall take all necessary action to cease such violation.
Updates to this AUP. CreditXpert may modify this AUP at any time by posting the revised AUP on its website or making the revised AUP available through the Solutions. Your use of the Solutions after the date a revised AUP is posted indicates your acceptance of the revised AUP. This version was published on October 16, 2024.
